Murphy, a partner in the firm, recently won a $1.66 Million verdict in Dallas, Texas in a case involving the transmission of genital herpes.
According to court documents, the Defendant, N.F., is an anesthesiologist who met and started dating the Plaintiff in early 2012. The Plaintiff alleged that she asked N.F. if he was infected with any sexually-transmitted infections and he specifically denied any infections. Shortly after engaging in sexual intercourse, the Plaintiff experienced an initial outbreak of genital herpes. The Defendant continued to deny any knowledge that he was infected. Since her initial outbreak, the Plaintiff has continued to experience recurrent, chronic outbreaks of genital herpes and has been diagnosed with post-herpetic neuralgia; a painful nerve condition resulting from damage caused by the herpes virus. At trial, the evidence showed that Defendant knew he had been infected for over 30 years but he claimed to have told the Plaintiff that he was infected before they engaged in sexual intercourse.
After only three hours of deliberations, the jury found the Defendant liable for: assault, fraudulent concealment, and fraudulent misrepresentation. The jury awarded $665,022 in compensatory damages and $1,000,000 in punitive damages. "We are, of course, extremely pleased with the jury's verdict," said Mr. Murphy. Adding, "As a doctor, he had a greater responsibility to protect others and take precautions not to transmit an infection he had been aware of for more than 30 years." Mr. Murphy also explained that, "the jury did not believe him when he said he disclosed to her before they engaged in sexual intercourse that he was infected. His story was simply not believable."
The verdict in the Texas case represents the largest verdict in that state for the transmission of an STD. Mr. Murphy is the leading trial attorney in this personal injury field. He has obtained the largest jury verdicts for transmission of genital herpes in California and now in Texas, and this is the third verdict in excess of a million dollars he has obtained in the last six years.
