Teachout, who is challenging Governor Andrew Cuomo’s in the New York’s Democratic Primary, says that understanding of political corruption—rooted in ideals of civic virtue—was a driving force at the Constitutional Convention. The framers worried that abuse of power, self-serving behaviors, even gifts to public servants were potentially corrupting and could endanger the new republic. In consequence they built numerous “prophylactic safeguards” into the Constitution.

Since the 1970, Teacher charges, the Supreme Court progressively dismissed those safeguards and narrowed the definition of corruption to one thing: explicit bribery. Using this logic, its 2010 Citizens United decision gave corporations the right to spend limitless money to influence elections (in SCOTUS-speak, to access democratic responsiveness). With unlimited spending transforming US politics for the worse, warns Teachout, the American experiment in self-government could collapse.

Are there remedies? Teachout, who is also challenging Andrew Cuomo for the Democratic gubernatorial nomination, puts forth a number of eminently practical & constitutionally sound ideas.

Zephyr Teachout is a constitutional law professor and organizer who is running for governor of New York. Teachout is best known for her efforts to limit the influence of money on politics. Her arguments were cited in the Citizens United case by Supreme Court Justice John Paul Stevens. She is one of the leading legal experts on corruption. She has worked on political campaigns at every level. She was head of online organizing for Howard Dean’s 2004 presidential campaign. After the market crash of 2008, Teachout co-founded a group dedicated to breaking the power of Wall Street banks. After graduating law school at Duke, Teachout founded a criminal defense non-profit in Durham, NC, where she helped lead the fight against the death penalty. It was during these years Zephyr came to understand that lawmaking is not a science but rather a moral and political art.
