Supreme Court Ruled out Parking Fine Case

Doncaster, England -- (SBWire) -- 11/30/2015 --A chip shop owner from Billericay recently had his parking ticket challenge ruled out by the Supreme Court. Barry Beavis was fined £85 for over-staying 56 minutes on a two hour free stay car park. Mr Beavis challenged ParkingEye, claiming that the charge was excessive and disproportionate.

The car park in question was at a Chelmsford retail park which is in the middle of a busy city centre. Mr Beavis' solicitor argued that car parking fines should be set at levels so as to not make huge profits but to deter over stayers.

Seven Supreme Court justices considered the case and concluded the charge did not breach the 'Unfair Terms in Consumer Contracts Regulations' and was entirely lawful. According to the Court of Appeal, Mr Beavis had 'entered into a contract' with the London-based parking firm when he drove into the car park.

Mr Beavis argued he was pursuing the case for millions of other motorists who are regularly stung by parking tickets from private firms. The case has revealed that there are no boundaries when it comes to parking fine charges and that "Such is the nature of an unregulated industry scrambling to get as much money as it can from drivers," according to AA president Edmund King when talking to thisismoney.co.uk.
