North Carolina civil attorneys working with lawyers from the Internet Sweepstakes Network are asking a trial court judge to delay the enforcement of his order preventing police and sheriffs from turning off certain types of sweepstakes machines while the order is up for appeal.
The Attorney General's Office asked Guilford County Judge John Craig to stay his order that define a portion of the ban on video or Internet-Sweepstakes-Based machines that took effect last week unconstitutional. His ruling said one catchall provision was too broad of a statement and infringed on free speech rights.
Special Deputy Attorney General Mark Davis wrote if the order is not delayed, people who are operating what lawmakers have deemed illegal gambling will be able to evade prosecution.
The state asked the Court of Appeals to review Craig's ruling says an unidentified cabinet chairperson.
