Each company must have an Asbestos Register to remain in compliance with the Control of Asbestos Regulations 2012 Regulation 4. This includes both duty holders and landlords. Many assume that they don't need to comply if they own a domestic premise, yet this isn't the case. Certain individuals, such as those who own flats with common areas, must ensure these common areas are in compliance.

The duty holder or landlord must not only identify these areas, but must also have a plan in place to monitor the condition of the materials which contain asbestos. In the event the condition of these areas deteriorates and there is a risk of fibres being released, action must be taken. Following the initial inspection, it is recommended that an annual re-inspection be completed, as the Asbestos Register must be reviewed regularly.
